These Terms & Conditions ("Terms") govern your use of Brain Dump (the "Service"), a voice-first AI thought-sorting application provided by Mubarak Mohammed Al Zadjali ("we", "us", "our", the "Seller"). By creating an account or using the Service you agree to these Terms.
1. The Service
Brain Dump records short voice notes, transcribes them, and uses AI to sort the contents into action buckets. Free accounts can submit a limited number of dumps per day; Pro accounts unlock unlimited dumps and additional features (Day Split, Assist).
2. Acceptance & eligibility
You must be of legal age in your jurisdiction (or have parental consent) to use the Service. If you accept these Terms on behalf of a company or other entity, you represent that you have authority to bind that entity.
3. Acceptable use
You must not, and must not attempt to:
- use the Service in violation of any law or regulation;
- commit fraud, send spam, or harass others;
- upload content that infringes third-party intellectual property or privacy rights;
- interfere with or compromise the security of the Service (malware, probing, scraping, brute force, denial of service);
- resell, sublicense, or redistribute the Service without our written consent;
- reverse engineer, decompile, or circumvent technical limits of the Service;
- use the Service to generate illegal content, hateful content, malware, deepfakes, or to jailbreak underlying AI models;
- use Service outputs as a substitute for professional advice (medical, legal, financial, or otherwise) without independent verification.
4. Account & accuracy
You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information at signup and keep it up to date.
5. Your content & AI outputs
You retain ownership of the audio you record and the text you submit ("User Content"). You grant us a limited, worldwide, royalty-free licence to host, transmit, transcribe, and process User Content solely to provide the Service to you. AI-generated outputs may be inaccurate, incomplete, or biased — you are responsible for reviewing them before acting on them. We may remove or refuse to process content that violates these Terms, and we may suspend repeat infringers.
6. Intellectual property
The Service, including its software, design, brand assets, and documentation, is owned by the Seller and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan and these Terms.
7. Payments, billing & refunds — Paddle as Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency, invoicing, cancellations, and refunds are governed by the Paddle Checkout Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled. See our Refund Policy for the change-of-mind window.
8. Service level
We work hard to keep the Service available, but we do not guarantee uninterrupted, error-free, or always-secure operation. To the fullest extent permitted by law we disclaim all implied warranties (including merchantability and fitness for a particular purpose).
9. Suspension & termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, create security or fraud risk, or commit repeated or serious policy violations. You may cancel your subscription at any time from the Settings page or via Paddle. On termination your access ends; we may retain backups for a reasonable period and then delete or anonymise your data.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid to us (via Paddle) in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, special, incidental, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, personal injury, or anything else that cannot lawfully be excluded.
11. Indemnity
You agree to indemnify and hold the Seller harmless from any claim arising from your User Content, your unlawful use of the Service, or your breach of these Terms.
12. Changes to the Service or Terms
We may update the Service and these Terms over time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the Sultanate of Oman. The courts of Muscat have exclusive jurisdiction over any dispute, subject to any non-waivable consumer rights in your country of residence.
